Cookie Policy

The Publisher may use cookies and, where applicable, collect browsing data, as detailed below, when the Site and its Services are used. The User will be informed of these processes and their purpose, and will have the option to consent to or refuse them.

Personal Data Protection Policy

This section is an integral part of the general terms and conditions of use of the website (hereinafter the “General Terms and Conditions of Use”) https://www.eloquant.com (hereinafter the “Site”) and aims to inform the User of the Site (hereinafter referred to as the “User”) about how the company ELOQUANT (hereinafter the “Publisher”) collects, uses, and stores the User’s personal data; it does not apply to personal data collected by other means.

1. Legal basis for the processing of personal data

Personal data processing is carried out in accordance with the General Data Protection Regulation (GDPR) of April 27, 2016, which came into effect on May 25, 2018, and the amended Act of January 6, 1978 relating to data processing, files, and civil liberties.

The Publisher has a legitimate interest in collecting personal data in order to conduct prospecting and commercial follow-up activities with Users who have consented through a contact form.

2. Commitments of the Publisher

The Publisher undertakes to comply with the General Data Protection Regulation (GDPR) of April 27, 2016, which came into effect on May 25, 2018, and the amended Act of January 6, 1978 relating to data processing, files, and civil liberties.

No personal data will be collected without the User’s knowledge, will not be used for purposes other than those stated below, nor will it be transferred to third parties without their consent.
 

2.1 Collection of personal data

The User may browse certain pages of the Site without providing any personal data (other than the IP address).

However, in certain cases (customised services, forms, emails, newsletters, thematic alerts, etc.) or for the use of specific services or features on the Site, various personal data may be requested from the User, such as their name, surname(s), email address (personal or professional), username, and password. If the User does not consent to providing such information, the Publisher requests that they refrain from using the services of the Site that require such consent.

No personal data is collected without the User’s consent. These details are only requested to the extent necessary.

2.2 Use of personal data

The Publisher uses the User’s personal data for the following purposes, including but not limited to:

  • Conducting solicitation operations;
  • Developing commercial statistics.

 

2.3 Sharing/Disclosure of personal data

The Publisher may disclose the User’s personal data in cases provided for by law in order to combat fraud or if the Publisher reasonably believes it is necessary to protect its customers or the public.

Except in the case described above, the Publisher will not disclose the User’s personal data to third parties without their consent.

2.4 Storage, confidentiality, and access to personal data

The User’s personal data is stored in a database on the Publisher’s servers. The User’s personal data may therefore be stored and processed for a period not exceeding the duration necessary for the purposes for which it was collected.

The Publisher undertakes to take all necessary precautions to preserve the confidentiality and integrity of this data, ensure it is not altered, damaged, or destroyed, and prevent any disclosure to unauthorised third parties.

The User has the right to access their personal data, provided they prove their identity, specify the personal data they wish to access and/or modify, and as long as the request is reasonable and justified.

2.5 Security of personal data

The Publisher considers the User’s personal data to be confidential and strives to take all reasonable technical measures to prevent any potential loss, misuse, or disclosure of the data to unauthorised third parties during the collection or storage process.

2.6 Transfer of personal data

The personal data provided by the User is intended for the Publisher. Subject to the User’s express consent, it may be shared with the Publisher’s commercial partners, who may send the User various information and offers related to their products or services.

In very exceptional circumstances, the Publisher may be legally required to disclose the User’s personal data, particularly when such disclosure is necessary for the identification, apprehension, or legal action against any individual who may have intentionally or unintentionally infringed the rights of third parties and/or violated applicable regulations.

2.7 Transfer of personal data abroad

The Publisher undertakes not to transfer any personal data abroad without the prior consent of the User, and in compliance with the legislation in force applicable to such transfers.

3. User rights

In accordance with the provisions of the General Data Protection Regulation (GDPR) of April 27, 2016, which came into effect on May 25, 2018, and the amended Act of January 6, 1978 relating to data processing, files, and civil liberties, the User has permanent rights to information, opposition, access, rectification, or deletion of personal data concerning them. The User may request that their personal data, which is processed, used, or shared by the Publisher, be corrected, completed, clarified, updated, locked, or erased if it is inaccurate, incomplete, ambiguous, or outdated.

The User may request the removal of their email address from the mailing list by clicking the link provided at the bottom of any email that may be sent to them.

To exercise the above rights, the User may also complete an online form that will be sent directly to the Data Protection Officer (DPO), available here.

The Publisher undertakes to review and respond, as far as possible, to the User’s request as quickly as possible, and within a maximum period of one month. This period may be extended for an additional two months in case of complexity or a high number of requests, in accordance with Article 12.3 of the GDPR.
 

4. Modification of the Privacy Policy

The Publisher may need to modify the present Personal Data Protection Policy due to an internal policy change and/or a change in the applicable regulations. It is the User’s responsibility to regularly review this Personal Data Protection Policy to stay informed of any modifications.
